關于加強國有資金投資建筑(zhu)工程項目(mu)監管的(de)意見

為維護公平競爭的建筑市(shi)場(chang)環境,從(cong)源頭(tou)治理國(guo)(guo)有資(zi)(zi)(zi)(zi)金(jin)(jin)投資(zi)(zi)(zi)(zi)建筑工程項(xiang)目違規操作以(yi)及“低價中標、高(gao)價結算”等突(tu)出(chu)問題,建立健全長效(xiao)機制,切實(shi)(shi)保障國(guo)(guo)有資(zi)(zi)(zi)(zi)金(jin)(jin)安(an)全,提高(gao)投資(zi)(zi)(zi)(zi)效(xiao)益(yi),結合我省實(shi)(shi)際,現就加強國(guo)(guo)有資(zi)(zi)(zi)(zi)金(jin)(jin)投資(zi)(zi)(zi)(zi)建筑工程項(xiang)目監管提出(chu)以(yi)下意見:
一、完善招標投標制(zhi)度
(一(yi))規(gui)(gui)范(fan)項(xiang)目(mu)(mu)(mu)招(zhao)(zhao)標(biao)(biao)行為(wei)。國有(you)資金投(tou)(tou)資建筑(zhu)工(gong)(gong)程項(xiang)目(mu)(mu)(mu)應(ying)(ying)嚴格按(an)照(zhao)規(gui)(gui)定(ding)履(lv)行審(shen)批核(he)(he)準(zhun)(zhun)程序。未經審(shen)批核(he)(he)準(zhun)(zhun)的項(xiang)目(mu)(mu)(mu),招(zhao)(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)監管部門(men)不(bu)得為(wei)其(qi)辦理招(zhao)(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)手續(xu)。依(yi)法必(bi)須(xu)進(jin)行招(zhao)(zhao)標(biao)(biao)的項(xiang)目(mu)(mu)(mu),應(ying)(ying)當按(an)照(zhao)審(shen)批核(he)(he)準(zhun)(zhun)的招(zhao)(zhao)標(biao)(biao)范(fan)圍、招(zhao)(zhao)標(biao)(biao)方式、招(zhao)(zhao)標(biao)(biao)組織形式等開(kai)展招(zhao)(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)活動。招(zhao)(zhao)標(biao)(biao)活動中(zhong)確(que)需改變招(zhao)(zhao)標(biao)(biao)事項(xiang)的,項(xiang)目(mu)(mu)(mu)建設單位(wei)應(ying)(ying)報(bao)原(yuan)審(shen)批核(he)(he)準(zhun)(zhun)部門(men)重(zhong)新辦理有(you)關手續(xu)。任何單位(wei)和(he)個(ge)人不(bu)得將(jiang)依(yi)法必(bi)須(xu)進(jin)行招(zhao)(zhao)標(biao)(biao)的項(xiang)目(mu)(mu)(mu)化整為(wei)零或者以其(qi)他任何方式規(gui)(gui)避招(zhao)(zhao)標(biao)(biao),不(bu)得將(jiang)應(ying)(ying)由一(yi)個(ge)承包單位(wei)承擔的建筑(zhu)工(gong)(gong)程肢解(jie)發包給不(bu)同(tong)的承包單位(wei),不(bu)得以不(bu)合(he)理的條(tiao)件限制(zhi)或者排斥潛在投(tou)(tou)標(biao)(biao)人,不(bu)得對潛在投(tou)(tou)標(biao)(biao)人實行歧(qi)視待遇。
(二)加強招(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)監(jian)管(guan)。依法(fa)必(bi)須進(jin)行(xing)招(zhao)標(biao)(biao)的(de)項目,應當進(jin)入統(tong)一(yi)的(de)公共資源交易平臺(tai)進(jin)行(xing)招(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)活動,并按(an)(an)照(zhao)項目屬(shu)地管(guan)理原則(ze),接受項目所(suo)在地人民政府指定(ding)(ding)的(de)建(jian)(jian)筑(zhu)工(gong)程(cheng)招(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)監(jian)管(guan)部門監(jian)管(guan)。未(wei)(wei)按(an)(an)規定(ding)(ding)進(jin)入統(tong)一(yi)的(de)公共資源交易平臺(tai)進(jin)行(xing)施工(gong)招(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)的(de),視為(wei)未(wei)(wei)依法(fa)確(que)定(ding)(ding)建(jian)(jian)筑(zhu)施工(gong)企業。未(wei)(wei)依法(fa)確(que)定(ding)(ding)建(jian)(jian)筑(zhu)施工(gong)企業的(de),建(jian)(jian)設行(xing)政主管(guan)部門不得辦理施工(gong)許可。推進(jin)建(jian)(jian)筑(zhu)工(gong)程(cheng)項目電子招(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao),提高招(zhao)標(biao)(biao)投(tou)(tou)標(biao)(biao)效率。提倡優質優價、優質優先(xian),堅決遏制和(he)打擊圍標(biao)(biao)串標(biao)(biao)、轉包、掛靠和(he)低于(yu)成本價報(bao)價等(deng)違法(fa)違規行(xing)為(wei)。
(三)推進(jin)建筑市(shi)場信用信息應(ying)用。進(jin)一(yi)(yi)步強化省(sheng)公共(gong)資(zi)源(yuan)交易監管(guan)平臺(tai)、工(gong)程(cheng)建設監管(guan)和信用管(guan)理平臺(tai)建設,實現與省(sheng)公共(gong)信用信息共(gong)享服務平臺(tai)互聯互通(tong),及時(shi)掌握(wo)國(guo)(guo)有(you)資(zi)金(jin)投(tou)(tou)(tou)資(zi)建筑工(gong)程(cheng)項(xiang)目(mu)投(tou)(tou)(tou)標(biao)人的信用信息,并(bing)將(jiang)信用評定結果(guo)應(ying)用于(yu)招(zhao)標(biao)投(tou)(tou)(tou)標(biao)活動中(zhong)(zhong),擇優確定投(tou)(tou)(tou)標(biao)人、中(zhong)(zhong)標(biao)人。國(guo)(guo)有(you)資(zi)金(jin)投(tou)(tou)(tou)資(zi)建筑工(gong)程(cheng)項(xiang)目(mu)招(zhao)標(biao)投(tou)(tou)(tou)標(biao)活動中(zhong)(zhong)應(ying)當開(kai)展行(xing)賄犯(fan)罪檔案查(cha)詢,對有(you)行(xing)賄犯(fan)罪記錄的單位和個(ge)人按規(gui)定作出一(yi)(yi)定時(shi)期內限(xian)制進(jin)入市(shi)場、取(qu)消投(tou)(tou)(tou)標(biao)資(zi)格等處(chu)置(zhi)。
二、加強工程造(zao)價管理
(四)嚴格控(kong)制(zhi)(zhi)(zhi)項目總投資。經批復核(he)定的初(chu)步設(she)(she)計(ji)(ji)及概算(suan)(suan)(suan)(suan)(suan)是項目建(jian)設(she)(she)和(he)控(kong)制(zhi)(zhi)(zhi)投資的基本依據,任何單位和(he)個人不得(de)擅自(zi)增(zeng)加建(jian)設(she)(she)內(nei)容、擴大建(jian)設(she)(she)規模、提高建(jian)設(she)(she)標(biao)準或改變設(she)(she)計(ji)(ji)方案。建(jian)設(she)(she)單位應當實行全過程造價控(kong)制(zhi)(zhi)(zhi),以(yi)投資估(gu)算(suan)(suan)(suan)(suan)(suan)控(kong)制(zhi)(zhi)(zhi)設(she)(she)計(ji)(ji)概算(suan)(suan)(suan)(suan)(suan),以(yi)設(she)(she)計(ji)(ji)概算(suan)(suan)(suan)(suan)(suan)控(kong)制(zhi)(zhi)(zhi)施工(gong)(gong)圖(tu)預算(suan)(suan)(suan)(suan)(suan),以(yi)施工(gong)(gong)圖(tu)預算(suan)(suan)(suan)(suan)(suan)控(kong)制(zhi)(zhi)(zhi)工(gong)(gong)程結算(suan)(suan)(suan)(suan)(suan),確保項目總投資控(kong)制(zhi)(zhi)(zhi)在設(she)(she)計(ji)(ji)概算(suan)(suan)(suan)(suan)(suan)以(yi)內(nei)。
(五)科學編(bian)制工程(cheng)造價(jia)(jia)(jia)。國有(you)資金投(tou)資建筑工程(cheng)項目應當(dang)采(cai)用工程(cheng)量清單(dan)計價(jia)(jia)(jia)方式編(bian)制工程(cheng)造價(jia)(jia)(jia),合理設(she)置并公布最高投(tou)標(biao)(biao)(biao)限(xian)價(jia)(jia)(jia)。嚴格控制招(zhao)標(biao)(biao)(biao)暫(zan)估價(jia)(jia)(jia)設(she)置,暫(zan)估價(jia)(jia)(jia)累(lei)計金額不(bu)得超過最高投(tou)標(biao)(biao)(biao)限(xian)價(jia)(jia)(jia)的(de)(de)10%,超過10%的(de)(de)不(bu)予備(bei)案。以(yi)暫(zan)估價(jia)(jia)(jia)形式包(bao)括在總承包(bao)范圍(wei)內的(de)(de)工程(cheng)、貨物、服務,屬于依法(fa)必須進行招(zhao)標(biao)(biao)(biao)的(de)(de)項目范圍(wei),且達到國家規(gui)定規(gui)模標(biao)(biao)(biao)準(zhun)的(de)(de),應當(dang)依法(fa)公開招(zhao)標(biao)(biao)(biao)。招(zhao)標(biao)(biao)(biao)項目的(de)(de)合同條款中應當(dang)約定負(fu)責實施暫(zan)估價(jia)(jia)(jia)項目招(zhao)標(biao)(biao)(biao)的(de)(de)主體以(yi)及相應的(de)(de)招(zhao)標(biao)(biao)(biao)程(cheng)序(xu)。
(六)加強(qiang)合(he)(he)同(tong)(tong)價(jia)(jia)格管理。招(zhao)(zhao)標(biao)人(ren)和(he)中(zhong)標(biao)人(ren)應當按照法律法規規定簽訂(ding)書面合(he)(he)同(tong)(tong),合(he)(he)同(tong)(tong)的(de)(de)(de)標(biao)的(de)(de)(de)、價(jia)(jia)款(kuan)、質量、履行(xing)期限等主要條款(kuan)應當與招(zhao)(zhao)標(biao)文件和(he)中(zhong)標(biao)人(ren)的(de)(de)(de)投標(biao)文件的(de)(de)(de)內容(rong)(rong)相一致。招(zhao)(zhao)標(biao)人(ren)和(he)中(zhong)標(biao)人(ren)不得再另行(xing)訂(ding)立背離合(he)(he)同(tong)(tong)實質性內容(rong)(rong)的(de)(de)(de)其(qi)他協議。當事人(ren)就同(tong)(tong)一工(gong)程(cheng)另行(xing)訂(ding)立的(de)(de)(de)建(jian)設(she)工(gong)程(cheng)施工(gong)合(he)(he)同(tong)(tong)與經過備(bei)案的(de)(de)(de)中(zhong)標(biao)合(he)(he)同(tong)(tong)實質性內容(rong)(rong)不一致的(de)(de)(de),以備(bei)案的(de)(de)(de)中(zhong)標(biao)合(he)(he)同(tong)(tong)作為結算(suan)工(gong)程(cheng)價(jia)(jia)款(kuan)的(de)(de)(de)根據。
(七)嚴格(ge)控制工(gong)(gong)程(cheng)(cheng)變更(geng)(geng)(geng)(geng)。各地應(ying)結合實際(ji),進一步(bu)建(jian)立健全工(gong)(gong)程(cheng)(cheng)變更(geng)(geng)(geng)(geng)管理制度,明確工(gong)(gong)程(cheng)(cheng)變更(geng)(geng)(geng)(geng)的條(tiao)件、方(fang)式和造價確定(ding),除(chu)涉及工(gong)(gong)程(cheng)(cheng)結構(gou)安全等必(bi)須(xu)變更(geng)(geng)(geng)(geng)外,對(dui)其(qi)他變更(geng)(geng)(geng)(geng)應(ying)從嚴控制。嚴格(ge)工(gong)(gong)程(cheng)(cheng)變更(geng)(geng)(geng)(geng)分(fen)級審(shen)(shen)核程(cheng)(cheng)序,對(dui)重大設計變更(geng)(geng)(geng)(geng),必(bi)須(xu)報原(yuan)審(shen)(shen)批部門審(shen)(shen)批,且(qie)在施(shi)工(gong)(gong)現(xian)場公(gong)示審(shen)(shen)批后(hou)的變更(geng)(geng)(geng)(geng)內容。明確工(gong)(gong)程(cheng)(cheng)變更(geng)(geng)(geng)(geng)申報、審(shen)(shen)核、批準各環節責(ze)任,落實“誰(shui)簽字、誰(shui)負責(ze)”的工(gong)(gong)程(cheng)(cheng)變更(geng)(geng)(geng)(geng)責(ze)任追究制度。
(八)強化(hua)結(jie)算管理。工(gong)(gong)(gong)程(cheng)發包、承(cheng)包單(dan)位(wei)應(ying)按合同(tong)(tong)約(yue)定(ding)和規定(ding)程(cheng)序辦理過(guo)程(cheng)結(jie)算。工(gong)(gong)(gong)程(cheng)竣工(gong)(gong)(gong)驗收后,承(cheng)包單(dan)位(wei)應(ying)及(ji)時編制(zhi)竣工(gong)(gong)(gong)結(jie)算,建設單(dan)位(wei)應(ying)按規定(ding)審核竣工(gong)(gong)(gong)結(jie)算,并將竣工(gong)(gong)(gong)結(jie)算文(wen)件(jian)作(zuo)為工(gong)(gong)(gong)程(cheng)竣工(gong)(gong)(gong)驗收備(bei)案的(de)必備(bei)文(wen)件(jian)。嚴格執行(xing)最高投(tou)標限價、合同(tong)(tong)價、竣工(gong)(gong)(gong)結(jie)算價“三備(bei)案”制(zhi)度。
三(san)、強(qiang)化責任落實
(九)加強(qiang)(qiang)組織(zhi)領導。完善(shan)地(di)方政(zheng)府統(tong)一領導,住房(fang)城鄉建(jian)(jian)設(she)(she)、發展改(gai)革、審(shen)(shen)計(ji)(ji)(ji)(ji)、招標(biao)(biao)(biao)投(tou)(tou)(tou)標(biao)(biao)(biao)等監(jian)督管理部門(men)各司其(qi)職、協同配合的(de)監(jian)管長(chang)效機制。監(jian)督管理部門(men)應當依(yi)據職責權限(xian),加強(qiang)(qiang)對國有資金(jin)投(tou)(tou)(tou)資建(jian)(jian)筑工程(cheng)項(xiang)目的(de)審(shen)(shen)批核準(zhun)、行(xing)(xing)政(zheng)許可和(he)備(bei)案管理,規(gui)(gui)范招標(biao)(biao)(biao)投(tou)(tou)(tou)標(biao)(biao)(biao)、工程(cheng)變更等活動,及時發現和(he)查處違法(fa)(fa)違規(gui)(gui)行(xing)(xing)為(wei)。實行(xing)(xing)項(xiang)目審(shen)(shen)計(ji)(ji)(ji)(ji)全(quan)覆蓋,建(jian)(jian)立多(duo)部門(men)信息共享、審(shen)(shen)計(ji)(ji)(ji)(ji)移(yi)送(song)處理的(de)合作(zuo)機制。因監(jian)督管理部門(men)未(wei)履行(xing)(xing)職責或違反(fan)相(xiang)關規(gui)(gui)定增加建(jian)(jian)設(she)(she)內容、擴(kuo)大(da)建(jian)(jian)設(she)(she)規(gui)(gui)模、提高建(jian)(jian)設(she)(she)標(biao)(biao)(biao)準(zhun)、改(gai)變設(she)(she)計(ji)(ji)(ji)(ji)方案導致(zhi)工程(cheng)造價超概算的(de),應當依(yi)法(fa)(fa)依(yi)規(gui)(gui)對直(zhi)接(jie)負責的(de)主(zhu)管人員和(he)其(qi)他責任人員進行(xing)(xing)誡勉談話、通報批評(ping)或者給(gei)予相(xiang)應處分。省(sheng)住房(fang)城鄉建(jian)(jian)設(she)(she)廳(ting)會同省(sheng)發展改(gai)革委、省(sheng)審(shen)(shen)計(ji)(ji)(ji)(ji)廳(ting)等適時開展督查。
(十)加(jia)大查處力度。嚴格落實建(jian)(jian)設(she)(she)、勘(kan)察(cha)、設(she)(she)計(ji)、施(shi)工(gong)(gong)、監理等(deng)各方主體(ti)責任,加(jia)強對施(shi)工(gong)(gong)圖(tu)設(she)(she)計(ji)文件審(shen)查、工(gong)(gong)程(cheng)(cheng)造價(jia)(jia)咨詢、招標(biao)代(dai)理等(deng)中介機構的管(guan)理。因項(xiang)(xiang)(xiang)目(mu)建(jian)(jian)設(she)(she)單(dan)位(wei)(wei)擅自增加(jia)建(jian)(jian)設(she)(she)內(nei)容、擴大建(jian)(jian)設(she)(she)規(gui)模(mo)、提高建(jian)(jian)設(she)(she)標(biao)準、改變設(she)(she)計(ji)方案(an),或(huo)者由于管(guan)理不(bu)善、故意漏項(xiang)(xiang)(xiang)、報小建(jian)(jian)大等(deng)導致工(gong)(gong)程(cheng)(cheng)造價(jia)(jia)超概算的,當地政府應(ying)當依法依規(gui)對項(xiang)(xiang)(xiang)目(mu)建(jian)(jian)設(she)(she)單(dan)位(wei)(wei)主要負責人和直接負責的主管(guan)人員(yuan)以及其他責任人員(yuan)進行誡勉談話、通報批評或(huo)者給(gei)予相應(ying)處分。因勘(kan)察(cha)、設(she)(she)計(ji)單(dan)位(wei)(wei)未按(an)照項(xiang)(xiang)(xiang)目(mu)審(shen)批核準文件、工(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)強制性標(biao)準和國家規(gui)定的工(gong)(gong)程(cheng)(cheng)勘(kan)察(cha)、設(she)(she)計(ji)深度要求等(deng)編制勘(kan)察(cha)、設(she)(she)計(ji)文件造成工(gong)(gong)程(cheng)(cheng)造價(jia)(jia)超概算的,因施(shi)工(gong)(gong)、監理單(dan)位(wei)(wei)或(huo)者施(shi)工(gong)(gong)圖(tu)設(she)(she)計(ji)文件審(shen)查、工(gong)(gong)程(cheng)(cheng)造價(jia)(jia)咨詢、招標(biao)代(dai)理等(deng)中介機構違(wei)法違(wei)規(gui)行為造成工(gong)(gong)程(cheng)(cheng)造價(jia)(jia)超概算的,項(xiang)(xiang)(xiang)目(mu)建(jian)(jian)設(she)(she)單(dan)位(wei)(wei)可以根據法律法規(gui)和合同約定向有關單(dan)位(wei)(wei)追償。建(jian)(jian)設(she)(she)行政主管(guan)部門視情節輕重,依法給(gei)予相應(ying)行政處罰并記(ji)入不(bu)良信(xin)用(yong)記(ji)錄,情節嚴重的列(lie)入黑名(ming)單(dan)。
(十一)加(jia)強信息(xi)公開(kai)(kai)。凡不涉及(ji)國(guo)家安全和(he)國(guo)家秘密、法律法規(gui)未禁止(zhi)公開(kai)(kai)的(de)國(guo)有資(zi)金投(tou)(tou)資(zi)建筑(zhu)工(gong)程(cheng)項目,應當依托省(sheng)公共資(zi)源交易(yi)(yi)監(jian)(jian)(jian)管平(ping)臺、省(sheng)工(gong)程(cheng)建設監(jian)(jian)(jian)管和(he)信用(yong)管理平(ping)臺、省(sheng)建設工(gong)程(cheng)造(zao)價(jia)(jia)(jia)全過程(cheng)監(jian)(jian)(jian)管平(ping)臺和(he)當地主(zhu)要媒體,按(an)照有關規(gui)定向社(she)會公開(kai)(kai)項目信息(xi),包括項目名稱、規(gui)模、投(tou)(tou)資(zi)估(gu)算(suan)、設計概算(suan)、開(kai)(kai)竣工(gong)時間、交易(yi)(yi)信息(xi)、中(zhong)標價(jia)(jia)(jia)、合同(tong)價(jia)(jia)(jia)、履約信息(xi)、結算(suan)價(jia)(jia)(jia)、決算(suan)價(jia)(jia)(jia)、有關變更信息(xi)、增加(jia)造(zao)價(jia)(jia)(jia)的(de)原(yuan)因,以及(ji)相關責任主(zhu)體、監(jian)(jian)(jian)管處(chu)罰情況等,并公布舉報投(tou)(tou)訴電話,接受社(she)會和(he)群(qun)眾(zhong)監(jian)(jian)(jian)督。
